Where to Start with the Eviction Process
Every eviction begins with serving a notice. The type of notice you’ll need depends on the specific situation. Below, we’ve outlined the most common types of eviction notices and the steps involved in the eviction process. If you’re unsure which notice to file, don’t worry—we’re here to help. Types of Eviction Notices
- 7-Day Pay Rent or Quit Notice:
This notice is used when a tenant fails to pay rent. You must wait until any grace period in the lease has passed before serving the notice. If the tenant pays the full rental amount, you must accept it. After seven business days, if the tenant hasn’t paid, contact us to proceed with the eviction. - 5-Day Notice to Perform Lease Condition or Quit:
Used when a tenant violates the lease terms, this notice requires the tenant to correct the violation or vacate the property. After five business days, if the tenant hasn’t complied, a 5-Day Unlawful Detainer must be filed. - 3-Day Nuisance Notice:
For situations involving nuisances rather than rent issues, this notice requires the tenant to resolve the problem within three business days. If the issue persists, a 5-Day Unlawful Detainer follows. - 4-Day Notice to Surrender:
This notice is served to individuals living illegally on the property (squatters), giving them four days to vacate. - 7-Day Notice (Weekly Rentals):
Used for weekly rentals, this notice is a no cause notice. After seven business days, if the tenant hasn’t vacated, a 5-Day Unlawful Detainer must be filed. - 30-Day No Cause Notice:
This notice is used with there is no lease in effect or the lease is month to month. It runs for 30 consecutive days, including weekends and holidays, but does not include the day it is served. A 5-Day Unlawful Detainer follows after the 30 days. - 5-Day Unlawful Detainer:
This follow-up notice is used after a 3-Day Nuisance, 5-Day Notice to Perform Lease Condition or Quit, 7-Day No Cause Notice, or 30-Day Notice. The first day is the day after the notice is served, and it runs for five judicial days.
What to Do After Your Notice is Filed
Once your notice has been served by our licensed process server, you must contact us after the notice period has expired. If the tenant hasn’t complied, we will file a Summary Eviction with the court, requiring a signed copy of your lease. Once approved, we will instruct the constable to proceed with the lockout.
